What are permits and why do I need one?

Permits are the way in which the City of San Diego regulates construction. This is to ensure that all construction in the county is correctly and that the consumer is protected.

There are different types of permits, depending on the type of construction you are: structural, plumbing, mechanical, electrical and combination. Most residential projects require a combination of permits as most involve several types of work. Even the complete demolition or relocation of a building will require permits.

In the permit phase, you may need to create plans to submit to the City, make a plot plan for your property showing the improvements, and show the type of construction you'll be using. Once plans are approved, you will be required to build the project exactly to those plans. If any changes are made to the plans, they must be made with the city's approval.

When do I need a construction permit?

A construction permit is needed for all new construction. Often a permit is needed for repair, additions or improvements of existing fixtures/structures.

How long does it take to get a permit?

The times vary based on the project size. Some can be done right at the City Development office, but some permits will require that plans are left there for review.

What if I don't get a permit?

If a permit is needed, and is not obtained before construction, you will be in violation of City code and will be subject to fines and penalties. Then you'll be required to get permits for the project and it will have to pass inspection, sometimes the work will have to be re-done and in some cases you'll have to return the structure to its original condition. Not a good idea!

Who should apply for the permit?

Contractors licensed by the State of California or your agent can obtain permits. But you, the property owner, can also obtain the permits. If someone is obtaining them on your behalf please make sure the permit remains on your property, with the original set of plans; this is required by law.

What about inspections?

It is the contractor’s responsibility to call the City for inspections at specific times during construction. The project is not complete, legally, until it has passed final inspection. A good contractor will review the various stages with you and when inspections are required.
